Commission launches open consultation on the 28th regime to help companies grow and to enhance competitiveness in the EU
The European Commission launched an open public consultation on the proposed 28th regime. This initiative will help companies, including innovative ones, start-ups and scale-ups to overcome barriers when setting up and operating across the Single Market. It will do so by providing companies with a single set of rules, including an EU corporate legal framework based on digital by default solutions. In addition to company law, the results of the consultation will also help determine how we address aspects related to other areas of law, such as labour and taxation.
Henna Virkkunen, Executive Vice-President for Tech Sovereignty, Security and Democracy, said: “We want Europe to be an attractive place for start-ups and scale-ups. In order to help companies grow, we need to allow them to use a simpler set of rules when setting up and operating across the EU. We need to address obstacles that limit or slow down their growth in the Single Market and to incentivise them to continue operating within the EU”.
Michael McGrath, Commissioner for Democracy, Justice, the Rule of Law and Consumer Protection, said: “Companies across the EU have long been calling for a 28th regime that truly addresses the complexities they face when operating cross-border. We will turn this call into reality and invite companies and other stakeholders to share their specific experiences and challenges, so that we can devise the most effective framework to support them and fuel growth and innovation across the Single Market.”
The 28th regime was announced in the Competitiveness Compass, as well as in the Single Market and the Start-up and scale-up Strategies. The consultation is open from 8 July until 30 September 2025.
